Arvind Kejriwal Arrested: The Enforcement Directorate (ED) arrested Chief Minister Arvind Kejriwal on Thursday (March 21) night after several hours of questioning in a money laundering case in the alleged Delhi Liquor Policy scam. Arvind Kejriwal is the first Chief Minister who has been arrested as a CM. Today on Friday (22 March) ED will present him in PMLA court.
Last night, when ED was interrogating Arvind Kejriwal, the legal team of Aam Aadmi Party (AAP) also approached the Supreme Court through e-filing against his arrest, which is scheduled to be heard on Friday. On the other hand, AAP said that even though Arvind Kejriwal has been arrested, he will remain the Chief Minister of Delhi. If necessary, he will run the government from jail.
How will Arvind Kejriwal be able to meet his family?
After coming on ED remand, if Arvind Kejriwal’s family members want to meet him in ED custody, then they will be allowed to meet him only with the permission of the PMLA court. This is a legal process. As recently K. Kavita was taken on remand by ED, after which with the permission of the court, ED took her family members to K. Let me meet Kavita. Family members cannot bring any food or drinks for the accused in ED custody, but if the accused is unwell or the court gives permission, then it is possible that he may be allowed to eat home-cooked food.
What does the prison manual say?
Now the question is whether Kejriwal can run the government from jail? To understand this one has to understand the jail manual. First we have to understand how the prisoners are met in jail. According to the jail manual, it is possible to meet prisoners twice a week. The prisoner has to give the names of 10 people whom he wants to meet.
Appointments have to be booked via telephone. The time and date for the meeting is fixed by telephone. Three visitors at a time can come and meet in jail. During the meeting, on one side of the window is the prisoner and on the other side are the visitors. There is an iron grill and mesh in the middle. Meetings with prisoners can take place from 9:30 am to 12:30 pm. The jail superintendent decides the time of the meeting.
Can Kejriwal run the government from jail?
Jail has strict rules, in such a situation the question is whether the government can be run from jail. To understand this, let us know some more rules of the jail manual. A prisoner has no privileges in jail and no meetings can take place. Only legal assistants can sign documents in jail. That too, documents can be signed only with the permission of the court. If you sign any file while in jail, it is considered illegal.
